1. Services Provided
Vivid Memories provides digital photography services, including but not limited to:
- Digital photo enhancement and retouching.
- AI-assisted image generation and restoration.
- Virtual photoshoot coordination and background replacement.
- Digital gallery hosting and delivery.
2. User Submissions & Content
- Ownership: You retain all copyrights to the original images you upload.
- License to Use: By uploading content, you grant Vivid Memories a non-exclusive, royalty-free license to use, crop, and modify the images solely for the purpose of fulfilling your order.
- Prohibited Content: You may not upload images that contain illegal material, hate speech, or content that infringes on the intellectual property rights of others.
3. Payment & Refunds
- Pricing: All prices are as listed on our website at the time of purchase. We reserve the right to change pricing without prior notice.
- Payment Terms: Full payment is required before the commencement of digital work or delivery of high-resolution files.
- Refund Policy: Due to the digital nature of our services, refunds are generally not provided once work has begun. However, we offer up to two rounds of revisions to ensure satisfaction.
4. Intellectual Property of “Vivid Memories”
- All custom filters, proprietary AI workflows, website graphics, and branding are the sole property of Vivid Memories.
- Final “Edited Works” delivered to the client are for personal use unless a Commercial License is purchased separately.
5. Limitation of Liability
Vivid Memories is not responsible for:
- Loss of data or images due to technical failure beyond our control.
- The quality of the final product if the original image provided by the client was of poor resolution or quality (e.g., $72\text{ dpi}$ web thumbnails vs. $300\text{ dpi}$ print files).
- Indirect, incidental, or consequential damages arising from the use of our services.
6. Privacy & Data Protection
Your privacy is paramount. We do not sell your photos or personal data to third parties. Please refer to our Privacy Policy for details on how we use encryption to secure your uploads.
7. Delivery & Storage
- Delivery: Digital files will be delivered via a secure download link sent to your registered email.
- Storage: We guarantee to host your edited images for 90 days from the date of delivery. After this period, files may be permanently deleted from our servers.
